Discount rates

With the exception of consulting work not giving rise to the drafting and witnessing of a deed and the drafting and witnessing of certain so-called “free sector” deeds, notarial activities are for the most part subject to a single rate set by decree. The price of notarial services is therefore identical regardless of the client or geographical area. This rate is either fixed or proportional to the capital involved in the transaction.
Notaries’ regulated rates, included in the French Commercial Code, are laid down by Act no. 2015-990 of 6 August 2015, Decrees no. 2016-230 of 26 February 2016 and no. 2016-1369 of 12 October 2016 and the Orders of 26 February 2016, 17 October 2016 and 28 October 2016.
Since the Decree of 26 February 2016, a notary can apply a maximum discount capped at 10% of the amount of their fees, over and above a certain base tranche. This discount may be up to 40% for a certain list of specific deeds only, relating to property or rights worth more than €10,000,000.
